This Privacy Policy is designed to explain our privacy practices in a clear and practical way. It applies to information we collect directly from you, information collected automatically when you use the Platform, and information provided to us by businesses that use LoyaltyMojo to operate loyalty programs. By accessing or using the Platform, you acknowledge this Privacy Policy. If you do not agree with this Privacy Policy, do not use the Platform.

1. Who We Are

LoyaltyMojo, LLC provides software tools that help businesses create, manage, and operate loyalty programs, customer rewards, offers, promotions, customer engagement campaigns, and related customer relationship features. 2. Scope of This Privacy Policy

This Privacy Policy applies to two main groups of users:

  1. Business Customers — businesses, merchants, organizations, or individuals who create, manage, or operate loyalty programs, rewards, offers, promotions, customer lists, or communications through the Platform.
  2. Program Participants — customers, guests, consumers, or other individuals who join, use, or interact with a loyalty program, reward, offer, promotion, or communication powered by LoyaltyMojo. This Privacy Policy also applies to visitors to our website and individuals who contact us for support, sales, billing, legal, or privacy-related purposes. A Business Customer may have its own privacy policy, loyalty program rules, terms, or customer disclosures. LoyaltyMojo is not responsible for the privacy practices, representations, or policies of Business Customers, except as required by applicable law or written agreement. If you are a Program Participant, the business whose loyalty program you joined may control important decisions about how your information is collected, used, and communicated. You should also review that business’s privacy policy and loyalty program terms.

3. Our Role: Business, Controller, Service Provider, or Processor

LoyaltyMojo may handle personal information in different roles depending on the context. When we collect and use information for our own business purposes, such as operating our website, managing accounts, processing subscriptions, providing customer support, improving the Platform, preventing fraud, securing our systems, conducting analytics, and complying with legal obligations, LoyaltyMojo generally acts as an independent business or controller. When we process Program Participant information on behalf of a Business Customer so that the Business Customer can operate its loyalty program, send communications, manage rewards, or interact with its customers, LoyaltyMojo may act as a service provider, processor, contractor, vendor, or similar role under applicable privacy laws. Business Customers are responsible for providing their own legally required privacy notices, obtaining required consents, honoring customer privacy choices, and ensuring that their use of the Platform complies with applicable law. Where required, LoyaltyMojo may enter into a separate Data Processing Addendum or similar agreement with a Business Customer.

The personal information we collect depends on how you interact with the Platform. We may collect the following categories of information:

  • Account username
  • Password or authentication credentials

Business Customer Information

  • Business location information

  • Rewards, offers, discounts, promotions, and program rules

  • Customer lists uploaded or collected through the Platform

Program Participant Information

Depending on the loyalty program and Business Customer settings, we may collect or process:

  • Birthday or birthday month/day, if provided
  • Loyalty account number or identifier
  • Rewards activity
  • Points, visits, stamps, punches, credits, or similar loyalty activity
  • Redemption history
  • Offer participation

  • Purchase-related or transaction-related information if provided by the Business Customer or integrated systems
  • Customer notes or tags if added by the Business Customer

Payment and Billing Information

For paid plans, we may collect billing-related information such as:

  • Transaction identifiers
  • Last four digits of a payment card, card brand, expiration date, or similar limited payment details when provided by our payment processor We do not intend to store full payment card numbers on our own systems. Payment card processing is handled by third-party payment processors.

Communications and Support Information

If you contact us, we may collect:

Business Customers represent and agree that they have the legal right to provide this information to LoyaltyMojo and to use the Platform for the intended purposes. Business Customers are responsible for ensuring that customer information they submit to the Platform was collected lawfully and with all required notices, consents, permissions, and opt-out rights. Business Customers may not submit sensitive or regulated information unless LoyaltyMojo has expressly approved that use in writing and appropriate legal and security safeguards are in place.

6. Information We Collect from Program Participants

Program Participants may provide information when they:

  • Join a loyalty program powered by LoyaltyMojo
  • Sign up for rewards
  • Redeem an offer
  • Scan or use a QR code
  • Submit a form
  • Provide a phone number or email address
  • Participate in a promotion
  • Contact a Business Customer or LoyaltyMojo
  • Interact with messages or links sent through the Platform The Business Customer that operates the loyalty program may determine what information is requested and how that information is used for the loyalty program. Program Participants should contact the applicable Business Customer for questions about that business’s rewards, promotions, customer records, or loyalty program practices. Program Participants may also contact LoyaltyMojo using the contact information in this Privacy Policy.

7. Information Collected Automatically

When you access the Platform, we may automatically collect technical and usage information to operate, secure, measure, troubleshoot, and improve the Platform. This may include information about your device, browser, network, usage patterns, pages visited, features used, IP address, approximate location, error logs, and security events. We may use this information to:

  • Keep the Platform working
  • Detect and prevent fraud or abuse
  • Troubleshoot errors
  • Improve performance
  • Understand feature usage

10. How We Disclose Personal Information

We may disclose personal information as described below.

Business Customers

If you are a Program Participant, we may disclose your information to the Business Customer whose loyalty program you joined or interacted with. That Business Customer may use your information according to its own privacy policy, loyalty program terms, and applicable law.

Service Providers and Vendors

We may disclose information to vendors and service providers that help us operate the Platform, such as hosting providers, payment processors, email providers, SMS providers, analytics providers, customer support tools, fraud-prevention providers, security providers, and professional service providers. These providers are authorized to use information as needed to provide services to us, subject to applicable contractual and legal obligations.

Payment Processors

Payment information may be disclosed to payment processors to process transactions, manage subscriptions, prevent fraud, handle disputes, and comply with payment rules.

Integrations and Third-Party Services

If a Business Customer chooses to connect third-party services or integrations, information may be disclosed to or received from those services according to the settings chosen by the Business Customer and the third party’s own terms and privacy practices.

Legal, Compliance, and Safety Purposes

We may disclose information if we believe it is reasonably necessary to comply with law, legal process, court orders, subpoenas, government requests, regulatory requirements, law enforcement requests, or other legal obligations. We may also disclose information to protect rights, safety, security, property, platform integrity, customers, users, or the public.

Business Transfers

We may disclose or transfer information in connection with a merger, acquisition, financing, reorganization, bankruptcy, sale of assets, change of control, or similar business transaction.

With Consent or Direction

We may disclose information with your consent or at your direction.

11. Sale, Sharing, and Targeted Advertising

LoyaltyMojo does not sell personal information for money. However, some privacy laws define “sale,” “sharing,” or “targeted advertising” broadly. For example, certain advertising pixels, analytics tools, retargeting technologies, or cross-context advertising activities may be considered a sale, sharing, or targeted advertising under some state privacy laws. We do not sell personal information, share personal information for cross-context behavioral advertising, or use personal information for targeted advertising as those terms are defined under applicable state privacy laws. If applicable, LoyaltyMojo will provide a “Do Not Sell or Share My Personal Information” or similar opt-out mechanism where required by law.

12. Loyalty Programs, Rewards, and Financial Incentives

Some loyalty programs powered by LoyaltyMojo may provide rewards, discounts, points, offers, or other benefits to Program Participants. These programs are offered and controlled by the participating Business Customer, not LoyaltyMojo, unless LoyaltyMojo expressly states otherwise. To participate in a loyalty program, a Program Participant may need to provide personal information such as a name, email address, phone number, birthday, purchase-related information, or loyalty activity. The value of any reward, discount, point, offer, or benefit is determined by the participating Business Customer and may vary by program. Program Participants may choose not to participate in a loyalty program. Program Participants may also request to withdraw from a loyalty program by contacting the participating Business Customer or by using any available account, unsubscribe, or opt-out method. Withdrawal from a loyalty program may affect the Program Participant’s ability to earn, receive, or redeem rewards, points, discounts, or other benefits. LoyaltyMojo does not assign a monetary value to Program Participant personal information. Any value associated with rewards, discounts, points, or offers is determined by the participating Business Customer and is reasonably related to the value of the customer relationship, loyalty activity, or promotional offer provided by that Business Customer.

13. SMS, Email, and Marketing Communications

LoyaltyMojo Communications

We may send service-related communications, including account notices, billing notices, subscription notices, security alerts, password reset messages, support responses, legal notices, and Platform updates. Where permitted by law, we may also send marketing communications about LoyaltyMojo products, services, updates, offers, or events. You may opt out of marketing emails by using the unsubscribe link in the email or by contacting us. We will honor marketing email opt-out requests as required by law. Even if you opt out of marketing emails, we may still send service-related or transactional communications.

Business Customer Communications

Business Customers may use the Platform to send emails, text messages, reward alerts, loyalty updates, birthday offers, promotional campaigns, or other communications to Program Participants. Business Customers are solely responsible for obtaining all legally required consents before sending marketing emails, text messages, automated calls, push notifications, or similar communications through or in connection with the Platform. Business Customers are also responsible for maintaining consent records, honoring opt-outs, including required disclosures, and complying with the Telephone Consumer Protection Act, CAN-SPAM Act, state mini-TCPA laws, state email and telemarketing laws, wireless carrier rules, and other applicable laws.

Text Messages

If you provide your phone number and consent to receive text messages, you may receive transactional or promotional text messages depending on the loyalty program, account settings, and consent provided. Text message consent is not required as a condition of purchasing goods or services. Message frequency may vary. Message and data rates may apply. Reply STOP to cancel and HELP for help. You may opt out of text messages by replying STOP where supported or by following the instructions included in the message. You may receive a confirmation message after opting out. For help, reply HELP where supported or contact the applicable Business Customer or LoyaltyMojo. LoyaltyMojo does not guarantee message delivery, timing, open rates, click rates, revenue, customer response, or marketing results.

14. Business Customer Responsibilities

Business Customers are responsible for:

  • Providing accurate privacy notices to their customers
  • Obtaining required consent for data collection and communications
  • Honoring privacy rights and opt-out requests
  • Using customer data only for lawful purposes
  • Maintaining accurate customer records
  • Avoiding collection of unnecessary or prohibited information
  • Protecting account access and employee permissions
  • Complying with marketing, advertising, consumer protection, privacy, data security, loyalty, rewards, and promotion laws
  • Ensuring that rewards, offers, and customer communications are truthful and not misleading
  • Responding to customer questions about their loyalty program Business Customers may not use the Platform to collect or process sensitive personal information, children’s information, payment card numbers, protected health information, biometric data, government identification numbers, or other regulated information unless expressly approved in writing by LoyaltyMojo and supported by appropriate legal and security safeguards.

15. Data Retention

We retain personal information for as long as reasonably necessary to provide the Platform, maintain accounts, operate loyalty programs, process payments, provide support, comply with legal obligations, resolve disputes, prevent fraud, enforce agreements, maintain security, and conduct legitimate business operations. Retention periods may vary depending on the type of information and the reason it is retained. For example:

  • Account information may be retained while an account is active and for a reasonable period after closure.
  • Billing and transaction records may be retained as required for accounting, tax, legal, and fraud-prevention purposes.
  • Loyalty program records may be retained according to Business Customer settings, legal requirements, and operational needs.
  • Support records may be retained to help resolve future issues and maintain business records.
  • Security logs may be retained to detect, investigate, and prevent abuse or unauthorized access.
  • Backup copies may persist for a limited time according to our backup and disaster recovery practices. When information is no longer needed, we may delete, de-identify, aggregate, or anonymize it, subject to legal and operational requirements.

16. Data Security

We use reasonable administrative, technical, and organizational measures designed to protect personal information from unauthorized access, disclosure, alteration, and destruction. These measures may include access controls, authentication, logging, vendor controls, encryption where appropriate, monitoring, backups, and security review practices. No system is completely secure. We cannot guarantee absolute security of the Platform or information transmitted through it. If we become aware of a security incident involving personal information, we will investigate and provide notices as required by applicable law. You are responsible for protecting your login credentials, using secure passwords, limiting access to authorized users, reviewing account activity, and promptly notifying us of suspected unauthorized access. Business Customers are responsible for managing employee access, removing users who no longer need access, protecting exported data, and using the Platform securely.

Depending on your relationship with LoyaltyMojo and applicable law, you may have choices regarding your personal information. These may include:

  • Accessing or updating account information
  • Correcting inaccurate information
  • Requesting deletion of certain information
  • Opting out of marketing emails
  • Opting out of text messages
  • Managing cookies through browser settings or available cookie tools
  • Requesting a copy of certain information
  • Asking questions about how information is used If you are a Program Participant in a Business Customer’s loyalty program, some requests may need to be handled by the Business Customer because the Business Customer controls the loyalty program relationship. We may direct your request to the applicable Business Customer or work with the Business Customer to respond.

18. U.S. State Privacy Rights

Depending on your state of residence and whether a particular privacy law applies, you may have some or all of the following rights:

  • Right to know or confirm whether we process your personal information
  • Right to access personal information
  • Right to receive a copy of personal information in a portable format
  • Right to correct inaccurate personal information
  • Right to delete personal information
  • Right to opt out of the sale of personal information
  • Right to opt out of sharing personal information for cross-context behavioral advertising
  • Right to opt out of targeted advertising
  • Right to opt out of certain profiling or automated decision-making, where applicable
  • Right to limit the use or disclosure of sensitive personal information, where applicable

If we deny your request, in whole or in part, and applicable law gives you a right to appeal, we will explain how to submit an appeal. We will not discriminate against you for exercising privacy rights, but some features may not be available if we cannot process information necessary to provide them.

LoyaltyMojo does not sell personal information for money. LoyaltyMojo does not share personal information for cross-context behavioral advertising unless expressly disclosed in this Privacy Policy or through a required opt-out notice. If required, we will provide a “Do Not Sell or Share My Personal Information” link or similar mechanism.

Sensitive Personal Information

We do not use or disclose sensitive personal information for purposes that would require a right to limit under California law unless we provide the required notice and choice.

Business Customers may not knowingly collect, upload, request, or process personal information from children under 13 through the Platform unless they have obtained all legally required parental consent, have complied with all applicable children’s privacy laws, and LoyaltyMojo has approved the use in writing. If we learn that personal information from a child under 13 has been collected through the Platform without legally required consent, we may delete the information and suspend or restrict the related account, program, or feature. 21. International Users

LoyaltyMojo is based in the United States. If you access or use the Platform from outside the United States, your information may be collected, processed, stored, and transferred in the United States or other locations where we or our service providers operate. 25. Important Business Customer Notice

Business Customers should not rely on LoyaltyMojo alone to satisfy all privacy, marketing, promotion, consumer protection, or data security obligations. If you are a Business Customer, you are responsible for your own privacy policy, customer notices, consent language, loyalty program rules, SMS/email disclosures, advertising claims, reward terms, data retention practices, and compliance obligations. Before launching a loyalty program, Business Customers should confirm that their sign-up forms, QR codes, email campaigns, text campaigns, promotions, reward rules, and customer communications comply with applicable federal, state, territorial, local, and industry-specific laws.
